In this case the borrowers lost their non-judicial foreclosure case, hired FPG-USA and appealed. The investigative report was ordered in the form of an Affidavit which is an option available. The borrowers won their case at the Appeals level. The foreclosure was dismissed with prejudice against Bank of America.
