Richard Merrill Kahn

Richard Merrill Kahn has been FPG-USA's testifying expert working solely for borrower side contested foreclosure litigation since 2007. During that time he has represented in over 1,000 cases, across 37 states Nationwide. 

  • Richard is the senior testifying expert at FPG-USA. He is a U.S. Treasury, Internal Revenue Service Certified Acceptance Agent. SInce 2007 Richard has served as FPG-USA's senior testifying expert.

  • National Real Estate Tax Shelter Product Manager at Merrill Lynch headquarters in New York City for 5 years (1973-1977); appointed by Don Regan, CEO and Treasury Secretary under President Ronald Reagan;

  • Director of Affiliated Real Estate Analysts, Inc. (A.R.E.A.) a national residential and commercial real estate analysis firm based in NYC, facilitating purchases, sales and commercial mortgage financing for 15 years (1978-1994);

  • Director of a Whale Mortgage, a Florida based residential correspondent lender specializing in conventional and high end jumbo loan financing for 8 years (1995-2008).

  • For approximately 11 years (1984-1995), Richard worked with and assisted Federal Agency Task Forces specializing in real estate tax sheltered investments. This was both prior to and subsequent to the 1986 Tax Reform Act which stipulated the Real Estate Mortgage Investment Conduit (REMIC) rules for modern mortgage backed securitization.

CURRENTLY

  • Additionally, for the past several years (2008 - present), Richard has and continues to actively serve as  testifying litigation expert witness in residential and commercial real estate, financing, securitization and mortgage foreclosure fraud. To date, he has worked on over 1,000 cases nationwide, testifying in hundreds of cases across dozens of States (Alabama, Arizona, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, New Hampshire, New Jersey, Nevada, New Mexico, New York, North Carolina, Ohio, Oklahoma, Oregon, Pennsylvania, Tennessee, Texas, Utah,  Virginia, Washington and Wisconsin). 

  • Richard is Florida BAR accredited to instruct attorneys in Continuing Legal Education (CLE) and nationwide reciprocal BARs on his subjects of expertise; residential and commercial real estate, financing, securitization and mortgage foreclosure fraud.

  • Richard has been involved with real estate and tax aspect of the Foreign Investment in Real Property Tax Act (FIRPTA) since its enactment by the US Congress in 1980 (optional reporting) got teeth under the Debt Reduction Act in 1984 (mandatory reporting) and modified by the Path Act in 2015. He runs the FIRPTArefunds.com division of Forensic Professionals Group USA, Inc. It specializes in FIRPTA withholding, tax return filing, refunds & ITINs.
