FPG-USA does not perform borrower services directly with borrowers. Borrowers must engage FPG-USA services through authorized FPG-USA Clients. We highly recommend borrowers facing foreclosure find an able attorney to represent them, especially in non-judicial process states where the foreclosure may take place without the advance notice of a court action. Foreclosing lenders move on a dual track to foreclosure even while loan modification negotiations are occuring, therefore facing foreclosure we recommend loan modification professionals work with attorneys as well.

FPG-USA reports are designed to be used in civil actions, in all courts and all states. The Bill of Rights are part of the American Constitution and provide the right to bring a civil action in Court. Rules of Civil Procedure and Evidence provide guidance on submitting evidence. No law can restrict a party seeking their constitutional right of civil action from ordering credible mortgage analysis services they intend to use for this purpose. Furthermore, Congress has specifically provided consumers or their legal representatives with mechanisms to fight foreclosure under various government agency regulations such as Truth in Lending Act, Real Estate Settlement and Procedures Act, Home Ownership and Equity Protection Act; and Unfair Deceptive Acts and Practices that all 50 states have adopted in varying degrees as State consumer protection laws.

FPG-USA experience tells us that mortgage analysis that does not meet the standards of use in court is likely not going to have any leverage in negotiations of any type.

FPG-USA policy is not to recommend attorneys, loan modification professionals who work with attorneys or other third parties unaffiliated with FPG-USA.

FPG-USA provides attorney clients with expert witness support on every report we issue. We do not provide this service directly to borrowers under any circumstances. While it is a fact courts allow borrowers to represent themselves "pro se" in court, FPG-USA takes the position that a borrower who was not able to ascertain a possibly predatory or toxic loan before they took one out, is even more disadvantaged facing the legalities of foreclosure by lenders using seasoned attorneys. Our experience tells us that borrowers facing foreclosure have little or no chance of winning in court against lenders seeking to foreclose.

FPG-USA understands not all borrowers faced with foreclosure have found a qualified professional to represent them and may be seeking FPG-USA mortgage analysis reporting to help in this effort. Credible mortgage analysis lets the reader quickly ascertain violations or toxicity issues in the mortgage and in this way is important to the process. FPG-USA understands that in seeking outside qualified professional representation, a borrower would benefit by being able to hand a mortgage analysis report or findings to a prospective attorney or qualified professional whom they seek to interview or engage and receive an opinion right then and there instead of waiting for services to be performed.

For the above reasons, FPG-USA permits borrowers to order the following services through an authorized FPG-USA Client:

    Rescission Package
  • Forensic Lender Discovery
    Pre Assessment (if you do not know the true owner of the mortgage)
    Stage ONE (if you know the true owner of the mortgage)
  • Per inquiry assistance to an attorney to answer questions

All FPG-USA services provided to borrowers, as previously mentioned, must be conducted through an authorized FPG-USA Client. Borrowers pay the FPG-USA Client who then orders FPG-USA services and interacts with FPG-USA as necessary. The FPG-USA Client deals with the borrower. FPG-USA does not deal with borrowers directly under any circumstances except to refer a borrower making inquiry to an authorized FPG-USA Client.

Borrowers need to understand that FPG-USA provides quick turn times on orders and therefore recommends borrowers issue payment to FPG-USA Clients in cash equivalent form. This typically constitutes money order, bank check, wire transfer or direct deposit. It will not come as a surprise to find that many clients facing foreclosure are financially burdened and oftentimes personal checks bounce and credit card charges sometimes turn out to be made on accounts where the borrower is unauthorized to make a charge and result in a charge back scenario. It is not unusual to find the policy of many banks is to place long hold times on accounts who receive even a few checks that bounce. Fast turnaround of services may be critical in a case due to deadlines. FPG-USA therefore recommends the FPG-USA Clients accept cash equivalent form of payment from borrowers and in all instances provide a written receipt to the borrower for services provided.
